This Privacy Policy applies between our applications, software, websites, APIs, products, and services (collectively, the “Services” or “Competize”) and any third party that accesses our Services (collectively the “Users”). COMPETIZE SOLUTIONS S.L., the owner and provider of our Services, is a company incorporated in SPAIN with NIF B06750285 and address Avd/ Juan Pereda Pila, 4, 10B, CP, 06010, Badajoz. If you are a resident of the European Union, COMPETIZE SOLUTIONS S.L. is the controller of your personal Information for the purposes of EU data protection law. Scope of this Privacy Policy

This Privacy Policy was written in English. To the extent a translated version conflicts with the English version, the English version controls. Unless indicated otherwise, this Privacy Policy does not apply to third party products, services or the practices of companies that we do not own or control, including other companies and websites you might interact with or through our Services.

This Privacy Policy will be governed by and interpreted according to the law of the Spain. All disputes arising under the Privacy Policy will be subject to the exclusive jurisdiction of the English and Welsh courts. If any court or competent authority finds that any provision of this Privacy Policy (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this Privacy Policy will not be affected. In this Privacy Policy, unless the context requires a different interpretation: the singular includes the plural and vice versa; including is understood to mean including without limitation.

Every effort is made to keep our Services running smoothly. However, Competize takes no responsibility for, and will not be liable for the Services being temporarily unavailable due to technical issues beyond our control.

Information we collect

Competize collects Information about you, including Information that directly or indirectly identifies you, if you or other members choose to share it with Competize (collectively, the “Information”). We also collect Information about how you use our Services.

Account Information

  • We collect basic account Information such as User name, email address, date of birth, city, country, role in competitions and password that helps secure and provide you with access to our Services.

  • Profile and use Information is collected about you when you choose to upload a picture, cover photo, create a player profile (including height, weight, position and favourite foot). We also collect Information when you add, follow or join a match, team or competition (including organiser contact details, competition details, match results, player statistics and rankings, team squads, competition fees and payments, sponsor Information, news, photos).

  • Your name, profile and cover photos, match, team and competition related Information and any other content you share on the Services is publicly viewable on the Competize Services. This also may be indexed by search engines and be republished elsewhere on the Internet in accordance with our Terms & Conditions.

  • We collect and process location Information when you sign up for and use Competize Services. We collect this type of Information if you grant us access to your location. You can always remove our access using your web or mobile device settings. We may also derive your approximate location from your IP address.

  • To help us to provide you with the best possible Services, you can choose to provide us with your contact Information so we can better respond to your support requests and comments.
  • Information posted on behalf of other Users

  • As a User of Competize you can post personal Information on behalf of others, be they players, coaches, referees, organizers or fans. Before posting personal Information of others to Competize, it is obligatory that you inform them about our Privacy Policy, the use of their Information and that you obtain their explicit consent to share their personal Information. It is your sole responsibility to prove us that you have informed people from whom you provide us with their personal Information about this Privacy Policy and that you have received their explicit consent
  • Payment Information

  • If you sign up for a Trial (as defined in the Terms & Conditions), purchase any of our Paid Subscriptions (as defined in the Terms & Conditions), or make other purchases through the Service, your credit or debit card Information (such as your card’s type, expiration date, and certain digits of your card number), Paypal Information and other financial data that we need to process your payment may be collected and stored by us and/or the payment processors with which we work. We may also collect some limited Information, such as your name, mobile number, and details of your transaction history.

  • If you choose to pay by bank transfer or receive an invoice, Competize may need to collect and store additional Information and provide it to payment processors we work with.
  • Cookies, pixels and tracking data

  • We use cookies, log files, pixel tags, local storage objects, and other tracking technologies to automatically collect Information about your interactions, such as your searches, page views, date and time of your visit, and other Information about your use of the Competize Services. Before Competize places Cookies on your device, we will request your consent to accept those Cookies. You may deny the consent to placing of Cookies or delete saved Cookies; however certain features of our Services may not function as intended and you may lose personalisation settings.     How Information is shared

    We do not share your personal Information except in the limited circumstances described below.

    Service providers

    We may share your Information with third parties who provide services to Competize such as customer support, information technology, payments, sales, marketing, data analysis, research, and surveys. These service providers will only have access to the Information necessary to perform these limited functions on our behalf and are required to protect and secure your Information. We may also engage service providers to collect Information about your use of our Services over time on our behalf so that we or they may promote Competize or display information that may be relevant to your interests on our Services or other websites or services.

    Publicly available Information

    Subject to your account settings, your Information and content may be publicly accessible. We cannot and will not be responsible for what third parties do with any personal Information or other Information that you choose to make publicly available. As such, we advise that you exercise great care in determining what Information you choose to make publicly available through the Services. You may also authorize us to share your Information with others, for example, with Third-Party Accounts such as Facebook and Twitter

    Affiliates and acquirers of our business or assets

    Competize may, from time to time, expand or reduce its business and this may involve the sale and/or the transfer of control of all or part of Competize. Information provided by users will, where it is relevant to any part of our business acquired, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use the Information for the purposes for which it was originally supplied to us. We may also disclose Information to a prospective purchaser of our business or any part of it. In the above instances, we will take steps with the aim of ensuring your privacy is protected.

    Legal requirements

    We may preserve and share your Information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is reasonably necessary to comply with the law, including responses to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your Information if we determine that disclosure is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms & Conditions or fraud or abuse of Competize or its members, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

    Managing your personal Information

    You have the right to access, download, rectify or erase your Information, as well as the right to restrict and object to certain processing of your Information. While some of these rights apply generally, certain rights apply only in certain limited circumstances.

    You can delete your data by accessing the settings of your account. Alternatively, you can request the deletion or alteration of your data by email to the address unsubscribe@competize.com . The mail must be sent from the account registered in Competize.

    Retention of Information

    We keep your account Information, like your name, email address, password and age for as long as your account is in existence because we need it to operate your account. We keep other Information, like your match, team, competition and event data, until you delete the Information or your account since we use this data to provide you and other users with schedules, results, statistics and other aspects of the Services. Following your deletion of your account, it may take up to 30 days to fully delete your personal Information and system logs from our systems. We may retain Information from deleted accounts for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms & Conditions and take other actions permitted by law.

    Our policies for children

    We take additional measures to protect children’s privacy. You must be at least 16 years old or have the parental and/or legal guardian’s authorization to create an account. You can only accept the Privacy Policy and become a user of Competize, if you guarantee that you are over 16 years of age or, otherwise, you have previously received parental and/or legal guardian’s consent. You are solely responsible for obtaining this consent and you are solely responsible for stating that you are over 16 years of age.

    Competize may contact you to prove your actual age and, if applicable, prove that you have the appropriate parental and/or legal guardian’s consent. In this case you will have to provide us with a copy of your identification card or other official document containing your personal data, as well as any other documentation that may be necessary, in case you do not do so, Competize may deactivate and cancel your profile, either temporarily or definitely.

    We do not knowingly collect personal Information from children under the age of 16 without explicit parental consent; however if your child is registered with a national, state or local sport governing body, club, team, competition, event or other institution (collectively, the “Organisation”), such Organisation may provide us with the Information. The Organisation is solely responsible for obtaining and proving parental and/or legal guardian’s consent for sharing and publishing Information of children under the age of 16. If we learn that we have collected the personal Information of a child under the age of 16 without parental consent, we will take steps to delete the Information as soon as possible. Parents who believe that their child or other users have submitted personal Information to us and would like to have it deleted may contact us at info@competize.com.

    Our international operations and Information transfers

    We operate internationally, with our servers based in Dublin, Ireland. Your Information may be stored, processed in and transferred to other countries with privacy and data protection laws that differ from, and are potentially less protective than, the laws of your country. You acknowledge this risk and agree to data transfers when you create a Competize account and click “I agree” to our Privacy Policy and Terms & Conditions, irrespective of which country you live in.

    How we protect Information

    Data security is of great importance to Competize and to protect your Information we take several measures to safeguard the collection, transmission and storage of the data we collect. The Services use industry standard Secure Sockets Layer (SSL) and Transport Layer Security (TLS) technology to allow for the encryption of personal and financial Information. Although we strive to employ reasonable protections for your Information that are appropriate to its sensitivity, we do not guarantee or warrant the security of the Information you share with us and we are not responsible for the theft, destruction, loss or inadvertent disclosure of your Information or content. No system is 100% secure. Transmitting personal Information is done at your own risk.

    To help ensure that these measures are effective in preventing unauthorized access to your private Information, you should be aware of the security features available to you through your browser. You should use a security-enabled browser to submit your payment Information and other personal Information at the Services. If password access is required for certain parts of our Services, you are responsible for keeping this password confidential.

    Although our Services only look to include quality, safe and relevant Information, users are advised to adopt a policy of caution before clicking any external links published on our Services. We have no control over any external links despite our best efforts and are not responsible for the content of these links. This Privacy Policy does not extend to your use of such links.

    Our Services may contain sponsored links. Clicking on any such sponsored links will send you to the advertisers’ website which may use cookies and other tracking technology served under their Privacy Policy. Our Users click on sponsored links at their own risk and Competize cannot be held liable for any damages or implications caused by visiting any sponsored links

    Changes to Privacy Policy

    Competize reserves the right to modify this Privacy Policy at any time. Please review it occasionally. If Competize makes changes to this Privacy Policy, the updated Privacy Policy will be posted on the Services in a timely manner and, if we make material changes, we will provide a prominent notice. If you object to any of the changes to this Privacy Policy, you should stop using the Services and delete your account.
